1.0 Introduction.

Mama Parcel provides shopping, shipping, parcel forwarding, and package consolidation services from India to countries across the globe. Upon creating an account with Mama Parcel, you will receive a unique Indian Address and Locker Number where your packages can be delivered. Once Mama Parcel receives a package addressed to you, we will notify you and update your account dashboard with the package details.

After utilizing the available services linked to your account and selecting your preferred shipping option, Mama Parcel will forward your package to your international address as per your instructions.

Usage-Based Services and Shipping Charges:

Mama Parcel operates on a pay-as-you-use model for additional services, such as:

● Additional Photos

● Return Service

● Extended Storage beyond 30 days

● Package Consolidation

Shipping charges depend on the carrier or shipper you choose during the checkout process.

Domestic Returns Policy:

Mama Parcel facilitates free domestic returns for items purchased within India, subject to the seller's return policy.

2.0 User Agreement:

This User Agreement (“Agreement”) is a legal contract between you (referred to as ‘User,’ ‘Recipient,’ ‘You,’ ‘Member,’ and ‘Your’) and Navigable Express Private Limited, operating under the trade name Mama Parcel (referred to as ‘Mama Parcel,’ ‘We,’ ‘Us,’ or ‘Our’). Navigable Express Private Limited is a private limited company registered in India under Goods and Services Tax Identification Number (GSTIN): 36AAICN5786D1Z5 and Import Export Code (IEC): AAICN5786D

By accessing or using the services offered by Mama Parcel, you agree to comply with the terms and conditions outlined in this Agreement.

All services offered by Mama Parcel are described on the website and are collectively referred to in this Agreement as “Services.” By using the Site or the Services, you agree not to engage in any activities that are unlawful, unethical, or prohibited by the terms, conditions, and notices outlined in this Agreement.

This Agreement supplements the terms and conditions for the Services described on the Site. By accessing the Site or creating an account on, you accept and agree to abide by the terms of this Agreement. If you do not agree to these terms and conditions, you must not use Mama Parcel’s Site or Services.

We reserve the right to amend, modify, or change the terms of this Agreement at any time by posting the updated Agreement directly on the Site. These changes take effect immediately

upon being published. By continuing to use the Site or Services after changes are posted, you agree to the updated terms.

Please carefully read the full terms and conditions of use before utilizing Mama Parcel’s Site. By using the Site, you confirm that you are at least 18 years of age and agree to these terms and conditions.

Prohibited Uses:

You agree not to use Mama Parcel’s Site or Services to:

1. Harm or threaten to harm Mama Parcel or its users in any way, including using information provided here to compete against Mama Parcel;

2. Impersonate any individual or entity (including Mama Parcel or its agents) or misrepresent your affiliation with any person or entity;

3. Upload, share, or transmit content that infringes on the copyright, trademark, trade secrets, patents, or any other rights of a third party;

4. Violate any applicable laws, whether local, state, national, or international, intentionally or otherwise;

5. Forge headers or manipulate identifying information to disguise your identity;

6. Provide fraudulent, inaccurate, or incomplete information to Mama Parcel, shipping services, or government agencies;

7. Interfere with or disrupt the Services, Site, servers, or networks connected to the Site, or

violate any policies or regulations related to network operations;

8. Collect or store personal data of other users without their consent;

9. Violate the privacy of others by collecting or sharing their information unlawfully; or

10. Upload to Mama Parcel’s servers or networks any content containing viruses, malware, or other harmful code designed to interrupt, damage, or limit the functionality of software, hardware, or communication systems.

3.0 About Our Website

3.1 Restriction on Automated Queries

Automated queries are strictly prohibited on the Mama Parcel website unless expressly authorized in advance. Examples of such queries include, but are not limited to:

● Using software to analyze the ranking of pages or content on the Site;

● Conducting "meta-searches"; and

● Performing offline searches or similar activities on any part of the Mama Parcel platform.

3.2 Restrictions on Copying and Use

You may not (and shall not allow others to):

● Copy, alter, create derivative works, reverse engineer, decompile, or attempt to discover the source code of the Services or the Site;

● Sell, assign, sublicense, or otherwise transfer any rights to the Services or the Site;

● Remove or hide copyright or proprietary notices on the Site; or

● Reproduce, store, or distribute Site content for commercial purposes without prior written

approval from Mama Parcel.

3.3 Intellectual Property Rights

All content on, including design, text, graphics, and interface layouts, is protected by copyright and is either owned by Mama Parcel or licensed by third parties.

Upon receiving a copyright claim, Mama Parcel will review and, if necessary, take appropriate action such as removing the content in question.

3.4 Account Registration

To access Mama Parcel’s Services, you must create an account by completing the registration process with accurate, up-to-date, and complete information.

Failure to provide accurate information or updating it as necessary may result in suspension or termination of your account.

3.5 Fraud Prevention Policy

Mama Parcel actively prevents fraudulent activities by implementing industry-standard tools and technologies. All items sent to Mama Parcel must be legally purchased and fully paid for by you. If we detect or are informed of fraudulent activity, Mama Parcel reserves the right to:

● Hold shipments until verification by the seller or relevant parties;

● Cancel Services as deemed necessary.

3.6 Security of Your Password

Once registered, you are responsible for safeguarding your Mama Parcel account password. Do not share your password with anyone, and promptly report any unauthorized access to your account.

All actions performed using your password are your responsibility, even if unauthorized.

3.7 Account Verification Process

Mama Parcel may require you to provide identification documents (e.g., driver’s license, passport, or utility bills) for account verification. Details on required documents will be available on your account page.

3.8 Restricted and Prohibited Items Policy

Mama Parcel does not ship restricted or prohibited items, including weapons, illegal substances, or other items restricted by laws or regulations. It is your responsibility to ensure compliance with restrictions applicable to your destination country.

Mama Parcel cooperates with law enforcement agencies to prevent prohibited items from being shipped. This includes routine inspections of our facilities and packages. By using our Services,

you consent to such inspections. If prohibited items are found:

● Packages may be seized by law enforcement or Mama Parcel;

● Your account may be suspended or terminated;

● Additional packages in your Locker may also be subject to inspection or confiscation.

4.0 Services We Offer

4.1 Packages vs. Letters and Magazines

Mama Parcel primarily focuses on forwarding packages and does not typically handle the forwarding of letters or magazines. If you require forwarding of such items, you must make a special request. Please note that Mama Parcel will not forward government-issued IDs, credit cards, gift cards, SIM cards, or similar items.

4.2 Address Requirements

All packages sent to Mama Parcel must have the correct address details, including your full name and your unique Locker Number. If a package arrives with incomplete or incorrect details (e.g., missing Locker Number or an unknown/misspelled name), Mama Parcel will make reasonable efforts to identify the owner. If the owner is identified, the package will be assigned to the correct account. However, if ownership cannot be determined, the package may be disposed of at Mama Parcel’s discretion.

4.3 Storage Policy

Mama Parcel offers free storage for packages for up to 30 days while awaiting the payment of fees or the arrival of additional items for consolidation. If storage is required beyond this period, users may opt to extend storage for an additional fee. Packages left beyond the storage period without any requests will be considered abandoned.

4.4 Handling Abandoned Packages

Mama Parcel reserves the right to dispose of any abandoned or unclaimed packages in accordance with its policies.

4.5 Package Returns

Mama Parcel cannot refuse packages delivered to its warehouse. However, packages can be returned to the sender or vendor after being processed into your account. This service can be initiated through a Return Request, which is offered free of charge.

4.6 Oversized Packages

Oversized packages are those exceeding the weight or size limits of the specified carrier. These packages may need to be divided, reduced, disposed of, or returned to the sender if they exceed carrier limits. The maximum weight for a single piece is 70kg, and the maximum dimensions are

120cm x 80cm x 80cm.

4.7 Package Photography

Upon request, Mama Parcel will open and photograph the contents of your package. This allows you to confirm that the merchandise is accurate and in good condition before initiating a Return Request.

4.8 Package Consolidation

Mama Parcel is not liable for missing items from consolidated packages unless there is proof that the item was received at the warehouse. To ensure accuracy, we encourage users to request photos of package contents before consolidation. All photo requests must be submitted prior to the consolidation process. During consolidation, cartons will be removed to minimize shipping costs unless otherwise specified by the user.

4.9 Operational Timelines

The following timelines apply to Mama Parcel's processes:

● Inbound: 24 to 48 hours from the time the package is delivered to our warehouse.

● Consolidation: 24 to 48 hours from the time you submit a consolidation request.

● Dispatch: 24 to 48 hours from the time the shipping charge is paid.

Operational Hours: Monday to Friday, 10 AM to 7 PM.

5.0 Additional Services

5.1 Personal Shopper Assistance

Mama Parcel offers assistance in purchasing products from local and online stores in India. However, we are not responsible for the quality of goods, warranties, delivery issues, or any backup orders. If a purchase cannot be completed for any reason, Mama Parcel cannot be held accountable.

Refund Policy:

● A full refund will be issued if the order is canceled by the vendor (e.g., due to product unavailability) or if the product is not received by us. Cancellations initiated by the

● customer after placing the order are not allowed. However, packages can be returned to the vendor after they are processed into your account via a Return Request, which is free of charge.

5.2 Package Pick-Up Service

Mama Parcel can arrange to pick up your shipments from any location in India. Shipments refer to all products consolidated, packaged, or invoiced together and handed over to a service provider for delivery.

Important Details:

● Mama Parcel acts as a facilitator for package pickup on behalf of customers.

● We use third-party courier services for this purpose, and their policies will apply to the

transaction.

● It is the customer's responsibility to:

1. Ensure packages are securely sealed and items are wrapped to prevent damage.

2. Print and attach a packing slip to the package, with an additional copy placed inside the box if required.

3. Provide a list of items in the package for verification.

4. Avoid including prohibited items (refer to the Prohibited Items Policy).

5. Opt for domestic package insurance to safeguard against potential damage.

Liability and Limitations:

● Mama Parcel is not responsible for damages or lost items once the package is handed over to the third-party courier service.

● For added assurance, customers can request a package-opening video for an additional

fee.

Customer Obligations:

You are responsible for ensuring the shipment is properly described, documented, marked, and packaged for safe transportation. Mama Parcel will not accept or process shipments containing illegal, prohibited, or hazardous items.

Limited Liability:

Mama Parcel's maximum liability for any loss, damage, or theft during transit is INR 5,000 or the actual value of the item, whichever is lower.

5.3 Custom Shopping Services

Mama Parcel provides assistance for custom shopping requests to cater to your unique shopping needs from India.

5.4 Medicines Delivery

Mama Parcel facilitates the purchase and shipping of medicines from India, subject to the following conditions:

Requirements:

● A valid prescription and identity proof are mandatory.

● Outdated prescriptions will require customers to provide updated versions.

Important Guidelines:

● Medicines and non-medicines cannot be combined in the same shipment.

● Shipments are limited to 1 kg per customer to avoid delays.

● Each shipment must include medicines for one patient only, and a prescription in the patient’s name is required.

● Procuring medicines may take 2–4 days depending on pharmacy stock.

Timelines:

● Once shipped internationally, delivery may take 15–20 days.

Disclaimer:

Mama Parcel acts solely as a facilitator and is not responsible for injuries or fatalities caused by incorrect medicines. Medicines are procured as per the customer’s prescription.

6.0 Customer Responsibilities

6.1 Import and Export Documentation

Customers are responsible for understanding and complying with all import and export regulations, including customs requirements of the destination country. Mama Parcel does not guarantee delivery of packages that violate Indian export regulations or the import laws of the recipient country.

Customer Responsibilities Include:

● Providing accurate customs declarations and documentation.

● Paying all customs duties and charges in the destination country, which are separate from Mama Parcel's service fees.

● Submitting all necessary information as required by Indian and international laws for customs clearance.

Mama Parcel acts solely as the customer's agent for export purposes. This includes receiving, sorting, consolidating (if requested), repacking (if requested), storing, and exporting items. The actual export and delivery are handled by third-party freight forwarders or carriers. Customers authorize Mama Parcel to prepare necessary export documents, such as shipping labels, certificates of origin, and airway bills.

6.2 Shipping

Mama Parcel works with reputed couriers such as DHL, FedEx, Aramex, India Post, and others, depending on availability. However, Mama Parcel is not responsible for the performance of these shipping services. Customers are encouraged to review the terms and conditions of these couriers, as they also apply to your shipment.

Customer Responsibilities Include:

● Ensuring the contents, size, and weight of the package comply with shipping regulations.

● Reporting any package-related issues within 15 days of delivery, supported by a package opening video.

● Bearing customs, duties, and charges associated with the shipment, including any additional fees due to discrepancies in declared dimensions or weight.

● Avoiding the inclusion of prohibited items (refer to Prohibited Items Policy).

Shipping costs are calculated based on the greater of actual or dimensional weight as per courier terms. Mama Parcel is not liable for:

● Delays caused by customs, government actions, natural disasters, or other unforeseen events.

● Packages held by customs or other authorities.

● Return shipping costs or additional customs charges for returned items.

6.3 Dormant Accounts

Accounts inactive for over two years will be considered dormant, and any account balance will be forfeited. Customers can request a refund of their balance anytime before the two-year inactivity period ends.

6.4 Billing Discrepancies

Customers are responsible for reviewing all charges on their accounts. Any discrepancies must be reported within 30 days of the billing date. Charges beyond this period are non-refundable.

6.5 Compliance and Conduct

Customers agree to:

● Comply with all applicable laws when accessing and using Mama Parcel's services.

● Refrain from collecting personal data or using email addresses from the Mama Parcel website for solicitation purposes.

Mama Parcel reserves the right to monitor website usage to ensure compliance with this agreement and may cooperate with law enforcement authorities in prosecuting violations.

6.6 Liability of Mama Parcel

Mama Parcel's liability is limited to the service fees (excluding shipping fees) charged for the shipment. Customers agree to indemnify Mama Parcel against any claims, damages, or legal fees arising from shipments.

Mama Parcel is not liable for errors or omissions caused by inaccurate information provided by the customer or for failure to provide all necessary shipment details.

6.7 Issues with Deliveries to Mama Parcel Facilities

Customers must verify that the packages received at Mama Parcel’s warehouse match their order. Mama Parcel provides photographs of incoming packages for verification. Any discrepancies should be reported immediately to rectify errors.

6.8 Damaged, Missing, or Lost Packages

For lost or damaged packages, customers must file a claim within 10 days of delivery, supported by appropriate documentation (e.g., package opening video). False claims will result in a minimum charge of INR 750 plus investigation costs.

Claims and Insurance:

● Packages are insured by a combination of the courier’s shipping insurance and Mama Parcel's private insurance.

● Refunds for missing items are limited to the product cost or INR 5,000, whichever is lower.

● Customers can opt for shipment protection through delivery partners to cover damages or losses during transit.

Mama Parcel is not responsible for theft or delivery errors once the package is delivered to the customer’s address.

6.9 Delays

While Mama Parcel strives to process packages promptly, delays may occur. Customers will not be compensated for delays in locating or processing packages. If a package is sent to the wrong address due to an error by Mama Parcel, we will cover the shipping cost to redirect the package but are not liable for delays or inconvenience.

6.10 Termination of Services

Mama Parcel reserves the right to terminate customer access to its services without prior notice for any reason, including:

● Violations of the terms of this agreement.

● Lack of account activity.

Upon termination, all customer data may be deactivated, deleted, or retained at Mama Parcel's discretion. Customers may cancel their accounts at any time by contacting customer support.

If Mama Parcel terminates a customer’s account, any obligations under this agreement, including indemnification and liability limitations, will survive termination.

7.0 Insurance, Refund, and Cancellation Policy

Membership fees and shipping charges with Mama Parcel are non-refundable. Mama Parcel’s liability for any shipment transported by air (including ancillary road transport or stops en route) is limited by applicable international conventions, such as the Montreal Convention or the Warsaw Convention. In the absence of such conventions, liability is limited to the lower of:

1. The current market value or declared value, or

2. 19 Special Drawing Rights (approximately $26 USD) per kilogram.

For cross-border shipments transported by road, Mama Parcel’s liability is limited by the

Convention for the International Carriage of Goods by Road (CMR) to the lower of:

1. The current market value or declared value, or

2. Special Drawing Rights (approximately $14 USD) per kilogram.

If customers find these limits insufficient, they must declare a higher value and request additional Shipment Value Protectionor arrange for their own insurance.

Shipment Protection Insurance

Mama Parcel can provide shipment protection insurance to cover loss or damage to shipments, subject to the applicable premium, which can be viewed in the Ready to Ship section of the dashboard. This insurance does not cover indirect losses, delays, or damages caused by delays.

Excluded Countries:

Shipment Protection Insurance is not available for shipments to/from the following countries:

● Cuba

● North Korea

● Syria

Restricted Coverage Countries:

For countries like Iraq and Afghanistan, shipment protection applies only during international flights. Inland or domestic transit coverage may be arranged on a case-by-case basis.

Mama Parcel will make every reasonable effort to deliver shipments according to its standard schedules, but these schedules are not binding and do not form part of the contract. Mama Parcel is not liable for losses caused by delays.

7.1 Return Facilitation Service

Mama Parcel offers a return facilitation service for items that have not yet been shipped to the customer’s address. Returns are subject to the seller's policies, and Mama Parcel cannot influence or control these policies.

If a customer wishes to return a product after delivery to their address, the product must be sent back to Mama Parcel at the customer’s expense. Mama Parcel can then assist with returning the product to the seller, provided the seller supports returns.

7.2 Seller Return Policy

When requesting a return through Mama Parcel, customers are responsible for understanding the seller’s return policy, including potential shipping and handling fees. Mama Parcel will package and ship the item back to the seller as part of its service but does not guarantee refunds or returns if the seller declines the request.

7.3 Refunds

Customers have two options for refunds when receiving money back from a seller:

1. Apply Refunds to Future Services: Mama Parcel holds the refund amount and applies it toward future purchases, shipping costs, or service fees. Any remaining balance is refunded to the customer to minimize foreign transaction and exchange rate fees.

2. Direct Refunds: Refunds are processed in the customer’s local currency after deducting:

○ Currency conversion fees charged by payment systems (e.g., PayPal, credit card issuer).

○ Transaction fees from payment platforms.

○ Floating exchange rate variations.

Refunds will not include:

● Currency conversion fees.

● Credit card or payment system transaction fees.

● Variations in exchange rates.

7.4 Non-Returnable Items

If items cannot be returned (e.g., due to seller policies or elapsed return deadlines), Mama Parcel offers the following options:

1. Ship the items to a local Indian address provided by the customer (at additional cost).

2. Donate the items to a charitable organization.

3. Discard the items with written permission from the customer.

Note: Refunds cannot be processed for non-returnable items if the seller declines the return request.

7.5 Order Cancellations

Order cancellation policies depend on the seller’s terms and the status of the order with Mama Parcel:

1. Cancellation Before Order Placement with Seller:

○ The payment is refunded to the customer, minus:

◆ Currency conversion fees.

◆ Payment system transaction fees.

◆ Exchange rate differences.

2. Cancellation After Order Placement with Seller:

○ If the seller accepts the cancellation, the refund will be processed, minus applicable fees (as above).

○ If the seller does not accept the cancellation, Mama Parcel can assist with initiating a return request (if supported by the seller).

8.0 Miscellaneous

8.1 Indemnity

By using Mama Parcel, you agree to indemnify Mama Parcel, its officers, agents, partners, and employees against any claims, damages, or expenses (including reasonable legal fees) arising from:

1. Content you submit, post, or transmit through Mama Parcel’s platform.

2. Your use of or connection to Mama Parcel.

3. Your violation of the terms of this Agreement.

4. Your infringement of any rights of a third party.

8.2 Release

If you have a dispute with another user, merchant, or service provider through Mama Parcel, you agree to release Mama Parcel and its officers, employees, and agents from any claims, liabilities, or damages arising out of or related to such disputes. This release applies to all known or unknown, suspected or unsuspected claims, regardless of their nature or the legal basis.

8.3 Governing Law

Before initiating any legal action against Mama Parcel, you must:

1. Send a detailed written description of your claim via registered mail or a recognized courier service.

2. Negotiate with Mama Parcel in good faith for at least 30 days to resolve the dispute.

All legal correspondence must be directed to [Insert Contact Email].

This Agreement is governed by Indian law and is subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana (India). All communications and proceedings will be conducted in English.

8.4 Entire Agreement

This Agreement, along with our Privacy Policy (incorporated by reference), constitutes the entire agreement between you and Mama Parcel. It supersedes any prior agreements, whether oral or written, regarding the services provided.

8.5 Disclaimer of Warranties

Mama Parcel and its services are provided "as is" without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted or error-free operation of our platform or the accuracy and completeness of any content provided.

Mama Parcel may contain links to third-party websites or resources. We are not responsible for the availability, accuracy, or content of such websites or resources, nor do we endorse or guarantee any products or services offered through them. Any dealings with third-party merchants or advertisers are solely between you and them. Mama Parcel shall not be held liable for any loss or damage incurred as a result of such dealings.

8.6 Force Majeure

Mama Parcel will not be held liable for delays or failures caused by events beyond its control, including but not limited to:

● Acts of God

● Wars or civil unrest

● Transportation disruptions

● Labor strikes

● Natural disasters

● Telecommunications or infrastructure failures

● Hacking, spam, or cybersecurity incidents

● Vendor or supplier actions outside of Mama Parcel’s control

8.7 Severability

If any provision of this Agreement is deemed invalid or unenforceable by a court, the remaining provisions will remain in effect, and the invalid provision will be modified to the extent necessary to make it enforceable.

8.8 No Waiver

No waiver of any provision of this Agreement will be valid unless it is in writing and signed by Mama Parcel.
